The agreement between you and the coach who runs The Battery. Plain language where plain language works, and precise where it has to be.
Two sections worth reading closely. §11 limits what I owe you if something goes wrong, and §13 sends most disputes to arbitration instead of court — with thirty days to opt out of that, for free.
These Terms are a contract between you and Scott Haungs, who builds and runs The Battery as a personal project in Massachusetts ("The Battery", "we", "us"). They govern your use of the Battery application, website and any mobile app we publish (the "Service"). By creating an account or using the Service, you accept them. If you do not accept them, do not use the Service.
Our Privacy Policy is part of this agreement.
You must be at least 18 years old and able to enter a contract. The Service is for coaches and team staff. Do not create an account for a child, and do not let a child create one using your details.
Accounts are created by invitation. You are responsible for keeping your password confidential and for everything done through your account. Tell us promptly at support@lineupiq.app if you believe someone else has access.
Rosters, statistics, lineups and notes you enter are yours ("Your Content"). We claim no ownership of them. You grant us only the limited licence needed to host, store, process and display Your Content in order to run the Service for you and for coaches you invite.
You are responsible for the player information you enter. By entering it, you confirm that you have whatever permission your league, club, school or applicable law requires in order to record information about those players, and that you will honour a parent's or guardian's request to correct or remove a player's record.
The Battery stores a player as a first name and last initial and does not accept ages or dates of birth. Do not attempt to work around that by entering surnames, birthdays, contact details, medical or disciplinary information, or anything else sensitive, in a name field, a note field or anywhere else in the Service.
When you invite another coach to a team you own, you are giving a real person access to Your Content, including everything recorded about those players. Invite only people entitled to see it. You can view and revoke access at any time. Revoking access stops future syncing; it cannot retrieve information a person has already seen or copied.
The Battery produces suggested batting orders and defensive assignments from statistics and settings you supply. These are suggestions. They are estimates built on limited data from a small number of games, and youth sport is not predictable.
Do not: use the Service unlawfully; attempt to access another coach's account or data; probe, scan or test our systems' security; scrape, reverse engineer or copy the Service; resell or sublicense access; upload malware; or use the Service to harass anyone or to record anything about a player that a reasonable parent would object to.
Nothing. The Service is free, it is invitation-only, and there is no payment of any kind — no subscription, no trial that turns into one, no card on file.
That may change one day. If it ever does, we will tell you before any charge applies to you, and nothing will be billed without your express agreement at that time. Separate terms covering billing, renewal and refunds would be presented to you before you bought anything.
The Service is in private testing. It may contain defects, may be interrupted, and may change substantially. We may modify, suspend or discontinue features. If we discontinue the Service altogether, we will give at least 30 days' notice and a way to export Your Content first.
The Service keeps a copy of your teams on your own device so it works offline, and syncs when a connection is available. Syncing can fail, devices are lost, and software has bugs. Keep your own copy of anything you cannot afford to lose — the export tool is in the app under Setup → Account.
You may stop using the Service and delete your account at any time from inside the app. Deletion permanently erases your account, the teams you own and their rosters. It cannot be undone.
We may suspend or terminate an account that breaches these Terms, that we reasonably believe is being used to harm a child, or where required by law. Where circumstances allow, we will give notice and an opportunity to export first.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NOT BE LOST. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE BATTERY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED US DOLLARS. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
You will indemnify and hold harmless The Battery from claims, damages and reasonable legal costs arising from Your Content, your use of the Service, or your breach of these Terms — including any claim that you lacked permission to record information about a player.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules.
Before anything else, we talk. Write to support@lineupiq.app describing the problem and what you want done about it, and give us sixty days to sort it out.
After that, most disputes go to arbitration rather than court. Except for small claims and intellectual property matters, you and we agree that any dispute will be resolved by binding individual arbitration before the American Arbitration Association. That means no judge, no jury, and no class action. Section 18 of the full Terms sets out exactly how it works.
You can opt out, and it costs you nothing. Email support@lineupiq.app with the subject line "Arbitration Opt-Out" within thirty days of first accepting these Terms, and none of the above applies to you. We will not treat you differently for it.
Any dispute that is not arbitrated — because you opted out, because it belongs in small claims court, or because a court holds the arbitration agreement does not apply to it — will be brought exclusively in the state or federal courts located in Massachusetts, and you and we consent to their jurisdiction.
If you obtained the app from Apple: this agreement is between you and The Battery only, not Apple. Apple has no obligation to provide support or maintenance for the app. Apple is not responsible for any claim that the app fails to conform to a warranty, or for any third-party claim that it infringes intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
We may update these Terms; material changes get notice in the app before taking effect, and continuing to use the Service afterwards means you accept them. If a provision is unenforceable, the rest stands. Our failure to enforce a provision is not a waiver of it. You may not assign this agreement; we may assign it in connection with a sale of the project. These Terms and the Privacy Policy are the entire agreement between us about the Service.
